THE PROCEDURAL STEP
On 3 September, Reuters and AP reported on FIFA’s legal response to UEFA’s applications for evidence in the United States. The public court copies identify FIFA (AMERICAS), Inc. and FWC2026 US, Inc., together described in the memoranda as “FIFA U.S.”, as the proposed intervenors. The memoranda in New York and Colorado carry court filing stamps dated 1 September 2026.
The 3 September date in this chronology refers to the public reporting of the response, not the date the documents were filed. CONFIRMED applies to the existence, filing dates, contents and procedural requests recorded in those documents. It does not validate either side’s accusations.
WHAT FIFA U.S. REQUESTS
The two subsidiaries ask to intervene in the proceedings and to defer a decision on UEFA’s discovery applications until the Southern District of Florida rules on a parallel application. Alternatively, they ask for an opportunity to oppose the applications by 30 September.
These are motions to participate and to control the timing of the proceedings. The memoranda set out objections that FIFA U.S. wants the courts to consider; they do not themselves grant intervention, delay a case or dismiss UEFA’s applications.
WHAT FIFA U.S. ARGUES
FIFA U.S. argues that UEFA seeks evidence for contemplated Swiss criminal proceedings that have not been initiated and challenges whether UEFA can use the requested U.S. procedure for that purpose. It also characterises the applications as part of a “smear campaign” against FIFA and its leadership.
Those are the applicants for intervention’s legal arguments and descriptions of UEFA’s conduct. This article does not adopt them as findings about UEFA’s motives, the validity of its claims or the availability of discovery.
UEFA’S POSITION
UEFA’s New York application seeks documents and testimony for a contemplated Swiss complaint concerning the withdrawn FIFA Forward Enterprise proposal. UEFA alleges misconduct in the proposal’s development and asks to obtain evidence relevant to those allegations.
The discovery application is a procedural request, not a criminal charge. UEFA’s account remains its own allegation. The existence of that application does not establish criminal mismanagement, personal enrichment or other wrongdoing by Infantino or anyone else.
WHAT THE RECORD DOES NOT DECIDE
Neither the intervention memoranda nor the reports about them establish that a court has accepted either party’s narrative. An application is not a judicial decision, and FIFA’s response supplies neither proof of guilt nor an exoneration.
In the public court material and reporting reviewed by InFIFAntiNo on 6 September 2026, no decision granting or refusing the requested discovery on its merits, completed document production or confirmed deposition was identified. This is a bounded public-source check; procedural or briefing orders must not be confused with a decision on the discovery applications. The reviewed material also does not establish that a Swiss criminal complaint has been filed or that a prosecutor has opened an investigation.
